Thank you for contacting me regarding possible immunity towards telecommunications companies. It is good to hear from you.



As you may know, the National Security Agency (NSA) is the government agency responsible for signals intelligence. During the Cold War, the NSA primarily monitored communications of hostile military organizations and governments. Since the 1990s, the NSA has placed a much greater emphasis on "non-state actors," including terrorist groups and narcotics smuggling organizations which have become genuine national security threats.



Changing threats, coupled with the evolving global technological environment, have made NSA's mission far more difficult. The Foreign Intelligence Surveillance Act (FISA, 1978) was enacted with regard to past abuses of electronic surveillance for national security purposes to provide a statutory framework for the use of electronic surveillance in the context of foreign intelligence gathering. With the passage of FISA, Congress sought to strike the correct balance between collective security and individual rights when gathering foreign intelligence involving the use of electronic surveillance. Currently, collection of foreign intelligence information through electronic surveillance is governed by FISA and Executive Order 12333 (1981).



The Protect America Act makes a number of additions and modifications to FISA. This bill limits the construction of the term "electronic surveillance" so it does not cover surveillance directed at a person reasonably believed to be located outside of the United States. It also produces a mechanism for acquisition, without a court order under a certification by the Director of National Intelligence (DNI) and the Attorney General (AG), of foreign intelligence information in regard to a person reasonably believed to be outside of the U.S. The Protect America Act also gives the DNI and AG permission to direct a person with access to the communications involved to provide assistance to the government to facilitate such acquisitions and allows the Foreign Intelligence Surveillance Court (FISC) to review such procedures.



I support giving telecommunications companies' immunity, in cases where their assistance was requested by the federal government. These companies believed that they were operating in a lawful manner and complied with the government's requests. There also exist past cases where third parties acting in good faith are granted legal immunity.



The Senate passed the Protect America Act by a bipartisan majority of 68-29 on February 12, 2008. The Senate-passed version adds important liability protections for third parties who have helped defend our country. Without their cooperation, our intelligence officials will not have the tools they need to protect the American people. But our nation's trial lawyers see it another way; they would leave these firms exposed to a flurry of frivolous and costly lawsuits that would tie up our courts and endanger American lives. It's time for the House Majority leaders to put the safety of the American people above their own partisan political interests. It's time for them to heed the will of the American people and allow a vote on the Senate-passed FISA modernization bill.
